Coffman may take personal legal action against Obama

Rep. Mike Coffman announced Tues. that he may file a personal lawsuit against President Barack Obama over what Coffman sees as Obama's abuse of power.

Speaking on KHOW radio's Mandy Connell show, Coffman said America is in a "Constitutional crisis" due to Obama's "abuse of waving the so-called magic wand of this prosecutorial discretion."

Obama is "creating new law by not enforcing existing law, without going through Congress, a co-equal branch of government," Coffman said on air. (Listen to Coffman say, on KHOW 11-26-13, that he's considering legal action against Obama.)

"My office is engaged in the legal research right now of how do we take on the Administration," said Coffman on the radio. "It appears right now that we may have to do it, that I may have to do it, or somebody may have to do it, as an individual, outside of Congress, to litigate on one of these issues, the constitutionality. And I think you can litigate on one of them and establish a precedent that impacts all of them."

On the radio, Coffman was unclear about the specific instances of prosecutorial discretion would be the focus of his legal action.

In June, Coffman voted to strip "Dreamers," undocumented immigrants brought to this country illegally by their parents, of work permits and start deporting them, because, Coffman said, Obama over-stepped his authority in allowing immigration officials to defer deportation of them. (Yet, Coffman is also opposed to comprehensive-immigration-reform legislation, passed by Senate Republicans and Democrats, and he has yet to propose a specific plan that he would support.)

On KHOW, Coffman said he believes Obama exceeded his authority in lifting "certain elements of the [Iran] sanctions," in deciding that governors had some discretion under the 1996 Welfare Reform Act, and in implementing Obamacare.

One wonders what else Coffman is thinking of. Relaxing some federal drug enforcement measures relating to Colorado's marijuana statutes? (unlikely since Coffman has signed on to a bill allowing banks to conduct business with dispensaries). Maybe Coffman is also upset about Coffman's approach to DOMA?

Reporters might explore the irony that Coffman is wasting time with a hail-Mary lawsuit trying to stop Obama from getting stuff done via executive orders, which Obama has arguably been forced to use thanks to Coffman and his fellow obstructionist House Republicans.

Connell: …One of my great frustrations with the Republicans DC is that there does not seem to be a concerted effort to push back against these exact Constitutional abuses that you are talking about. Is this something that comes up in the Caucus about if there's any strategy. There has to be some way to tell the President of the United States that he cannot just on a whim choose to enforce or not enforce pieces of legislation that have been created by the Congress.

Reminder: DO NOT Take Legal Advice From Jon Caldara

Independence Institute President Jon Caldara says news that the attorney general is investigating former El Paso County Clerk staffer Alissa Vander Veen for voter fraud is not really surprising. For months he has been arguing and trying to demonstrate that a new law that put in place same-day registration in Colorado encourages troublemaking at the polls.

Caldara said he doesn’t remember ever speaking to Vander Veen or know anything about her case, but he added that he thinks the state’s Voter Access and Election Modernization Act “basically legalizes voter mischief.”

…Democrats, with the support of most of the state’s county clerks, passed the sweeping law last session, looking to increase voter turn out and up the efficiency of election administration for the digital age. Caldara joined Republican lawmakers in opposing the bill. He said so-called gypsy voters wold now be able to game the system by registering the day of the election wherever they wanted to vote in the state. Critics said the complaint was fear mongering and pointed out that state laws preventing voter fraud had not changed.

It was reported yesterday by the Colorado Independent that former El Paso County Clerk staffer Alissa Vander Veen is being investigated for violating rules for residency to vote in the Senate District 11 recall election in September. Vander Veen in fact used a VA loan to purchase a home in Pueblo last year, and such loans require the purchaser to use the home as their primary residence. Despite that, she reportedly affirmed an SD-11 address and voted in the recall election.

We'll be interested to see the results of that investigation, but for today, it's enough to be amazed by the endless chutzpah on display from another person under investigation for fraudulently voting in the SD-11 recall, the Independence Institute's director Jon Caldara.

Caldara, no stranger to the world of showy political statement, was determined to test the system. He posted a website encouraging “gypsy voting” and, although a longtime resident of Boulder County, he filed a transparently bogus registration in El Paso County and cast a blank ballot in the heated recall election there this summer.

“You know there’s an investigation on me as well,” Caldara said, deadpan. “That’s par for the course when there’s a complaint filed, the DA has to look at it. If the DA is conflicted, then he has to bump it up to the AG’s office… That’s not unusual, not necessarily nefarious.” [Pols emphasis]

Got that? Under investigation for felony vote fraud–"not unusual, not necessarily nefarious."

It is a truly absurd place we've arrived at in Colorado politics today, folks.

Porno-Grammy Jaxine Bubis Demands $54,000,000; Names As Legal Counsel Man Who Believes Colorado Doesn’t Exist

Jaxine Bubis only wrote erotica "to support her family," but she's got her eyes on a bigger prize than the meager royalties from "Beantown Heat": $54,000,000 in damages, demanded in a claim naming GOP State Chairman Ryan Call, El Paso County GOP Chair Jeff Hays, and others. The RMGO-endorsed would-be replacement for Senate President John Morse withdrew from her race following revelations about her erotic romance writings. Now, she wants compensation for the alleged illegal downloading and distribution of her NC-17 rated e-book, and for what Jaxine's criminal complaint calls "Terrorist Conspiracy to Trespass, Injury, and Harm a Woman." 

Jaxine's Claim "by Affidavit of Obligation," described as "A USSEC Tracer Flag Not a Point of Law," names Jeff Hays, Ryan Call, Paul Paradis, Bernie Herpin, and Kit Roupe as "Debtors," and claims the aforementioned are, "Using their labor and works to intimidate, slander, libel and defame (Jaxine) by way of stolen and pirated copyrighted materials (Book)." The claim is notarized by EmilyAnne Witt, verifying Jaxine's identity, and witnessed by Kyndra Slater-Cleaver and Patrick Mitchell. In her claim, Jaxine demands an immediate down payment of one million dollars from the above-named "Debtors," with the remainder of $54,000,000 (treble damages for a "claim of harm upon a woman") to be turned over within 90 days.

And that's where it gets weird…

A request for comment from Ms. Bubis was rebuffed with instruction to contact "Marc," who she described as, "my legal counsel." Upon reaching Marc–who was very friendly and polite–he did not wish to give his surname, but confirmed by phone that he advised Jaxine in her claim against several parties for the illegal downloading of "Beantown Heat" and alleged use of this e-book for illegal purposes. I asked Marc if he was aware that Jaxine's claim resembled templates used by members of the sovereign citizens movement. Marc vocally disavowed any agreement with sovereign citizenship (a fringe movement described by the FBI as associated with domestic terrorism). Marc also clarified that he is acting as Jaxine's legal counsel, but is not an attorney and has no formal legal background.

A few casual Web searches revealed that the email address Marc gave me for himself on the phone matches one used by a "Marc Harris" on podcasting platform TalkShoe, where the person describing himself as Marc Harris also claims to own a website, OPPT Congress (One People's Public Trust Congress), which is currently not online. However, the grizzly bear avatar used by Marc Harris on TalkShoe, and the description of OPPT Congress, match a "Bereagun" on the OPPT Court Cases forum. Bereagun is also the username used to upload Jaxine's "exhibits" to MediaFire, and in those exhibits are emails from a Marc Kaplan using an email address, beareagun@inbox.com, also referenced by Bereagun of OPPT Court Cases. Put the two names together and you get Marc Harris Kaplan, a person named (via Justia) in 17 court cases, including as plaintiff in a dismissed case claiming "Conspiracy to Interfere with Civil Rights," which named John Hickenlooper among several defendants. The photo to the right is from an online dating profile for Bereagun, in which the profile owner describes himself thusly:

Again, Marc seems like a very nice guy. Heck, aren't there some available women in his age bracket on this blog? You should send him a message on OKCupid, if so. Another dating site profile described him as a biker with an available back seat, so you're in for a fun ride. No sarcasm. He was as nice and polite as can be on the phone, and it's only in order to expose the bizarre legal doctrine behind Jaxine's complaint that I've dug so far into his identity. But, with that being said, here's Bereagun agreeing that Colorado doesn't exist:

The "Slave System" appears to reference Colorado and US law, judging by Bereagun's commitment to transfer Colorado and Wyoming into a new common law system:

It's also worth noting that OPPT appears to believe (there is no evidence Bereagun agrees) that it has lawfully foreclosed on the "system of Corporate-Governmental Rule," freeing us all from the so-called Slave System. Back to Jaxine…

Does Jaxine Bubis believe that Colorado doesn't exist, or that the government within which she campaigned for public office is a "slave system" that has been foreclosed upon through Universal Commerce Code filings? I don't know, because she won't tell me. Absent a comment from Jaxine, one can only presume that the legal counsel she authorized to speak for her represents her beliefs sufficiently, in her own estimation, to speak on her behalf. The RMGO-endorsed ex-candidate has a long list of hard-right conservative endorsers, including current US Senate candidate (and super super scary dude) Colorado Senator Owen Hill and his primary opponent, Sen. Randy Baumgardner:

Were the endorsers aware of Jaxine's association with members of OPPT, an organization which disavows the US government and espouses the superiority of a "common law" system when they endorsed her? If so, how do they square that with their support of her campaign for elected office in the "terminated" US government, which has been "foreclosed" by OPPT? Do any of the elected officials named above agree with OPPT's philosophies or associated with OPPT members themselves?

These questions, bizarre though they may be, are worth asking, especially in the cases of the two endorses now running against each other (and Ken Buck) for the opportunity to oppose Senator Mark Udall in 2014.

Although Jaxine's claim and criminal complaint specifically object to Ryan Call's refusal to support Bubis, even if she were on the ballot as a Republican in Morse's recall race, it isn't inconceivable that others on the RMGO-endorsed slate (the above endorsers list is also a pretty decent list of Dudley Brown's favorite elected officials) are also somewhat persona non grata with Chairman Call.

The El Paso County Republican Party managed to fail so thoroughly at candidate vetting that Jaxine Bubis entered a high-profile recall race with her own party unaware of her erotic writings, past legal challenges, and questionable associations. Might there be others like Bubis and her OPPT-loving legal counsel hiding in party ranks… or worse yet, under the state capitol's golden dome, having taken oaths of office to serve within a government they believe no longer exists?
