Who Will Replace Hudak in State Senate?

FRIDAY UPDATE: Kurtis Lee of the Denver Post reports that Rep. Tracy Kraft-Tharp will not seek appointment to the SD-19 seat vacated by Sen. Evie Hudak. Rep. Kraft-Tharpe reportedly endorses former Rep. Sara Gagliardi.

Democrat Evie Hudak's resignation from the State Senate on Wednesday effectively ended the attempted recall in SD-19, but it still leaves Democrats with a significant election battle in 2014.

Hudak was re-elected to the State Senate in 2012 by a slim margin over Republican Lang Sias, which meant Democrats wouldn't need to think about the seat again until 2016. With Hudak's resignation on Wednesday, Democrats don't have to worry that a recall election might swing control of the Senate into Republican hands for the 2014 session, but they still have to think about maintaining a majority into 2015. Democrats will fill Hudak's seat through a vacancy committee, but whoever wins the appointment will have to run for a full term next year.

Democrats have represented SD-19 for the last decade, with Sue Windels serving two terms prior to Hudak's 2008 victory, but the district has not been an easy seat to hold. With the 2014 election right around the corner, Democrats have a critical decision to make when the vacancy committee convenes.

There is certainly time for other candidates to emerge, but as of now, it looks like a potential three-way race among Rep. Tracy Kraft-Tharp, former Rep. Sara Gagliardi, and Arvada City Council member (and a former campaign manager for Hudak in 2012) Rachel Zenzinger.

All three candidates will have their share of supporters, all three have strong credentials, and all three can make a good case for why they should get the appointment. But from a purely strategic perspective — we're not going to get into any potential policy arguments here — one makes more sense than the other two. Here's why:

Rep. Kraft-Tharp could make the case that she is the logical heir to the SD-19 seat after her 2012 victory in HD-29, but she wouldn't likely have had a free run to the Democratic nomination in 2016 (Zenzinger was planning to run for SD-19 regardless of Kraft-Tharp's intentions). The strategic problem with nominating Kraft-Tharp to succeed Hudak is that it leaves two Democratic seats without an incumbent in 2014. While it's true that control of the Senate is going to be more difficult for Democrats to maintain than control of the State House, it would be tough for Democrats to give up Kraft-Tharp's incumbent advantage in HD-29. Kraft-Tharp has been a strong campaigner in HD-29, but she's not so well-known that she would have a significant edge over a Republican opponent in SD-19; it's a bigger advantage for Democrats if Kraft-Tharp runs for re-election in HD-29 instead.

Gagliardi is a popular Democrat who served two terms in HD-27 (which was redrawn in the last round of redistricting) before losing her re-election bid to Republican Libby Szabo in 2010. As a nurse with strong ties to organized labor (SEIU), Gagliardi will likely have support from key Democratic allies in a vacancy committee, and she certainly has the experience and credibility to make a good argument for the appointment. The problem with nominating Gagliardi isn't about her — it's about the narrative it feeds into. The 2014 election will be spun by Republicans as a validation of the recall process (fairly or not), and that narrative is strengthened if Democrats appoint someone who was recently defeated at the polls by another Republican; it makes it easier for the GOP to say that Democrats are only paying attention to Democratic voters. It may not be fair to Gagliardi, but Democrats need to consider the reality of the situation as they try to retain SD-19 next November.

Barring any unforseen circumstances, that leaves Zenzinger as the most logical choice from a purely strategic perspective. Zenzinger was just re-elected to her Arvada city council seat without opposition, and that non-partisan position gives her the best opportunity of the three candidates to create her own narrative in 2014. As a campaign manager for Hudak in 2012, Zenzinger is also plenty familiar with the politics at play in SD-19. Zenzinger's name ID won't be quite as strong as that of Kraft-Tharp or Gagliardi, but given the recent dynamics surrounding the recall, that might actually be an advantage. And while it's true that Republicans may try to use Zenzinger's ties to Hudak to say that she will be more of the same, it's important to remember that Hudak was not unpopular in her district — Hudak had served in elected office on the state school board for years prior to her Senate win in 2008, and she was demonized by a small, vocal minority (many of whom weren't even residents of SD-19).

Democrats are fortunate to have three strong candidates to replace Hudak through a vacancy committee, and all three would be well-prepared to defend the seat in 2014. But it is purely circumstance — and not criticism of Kraft-Tharp or Gagliardi — that makes Zenzinger the most logical option at this point.

Obamacare’s Detractors Finally Running Out Of Time?

Better late than never. Better late than never.

As The Hill's Jonathan Easley reports:

The Department of Health and Human Services (HHS) is expected to release data later this month showing a “surge” in enrollees in the federal and state healthcare exchanges for November.

The numbers are expected to surpass the paltry figures for October, when enrollments were hampered by an erratic HealthCare.gov website plagued by outages and error messages…

Even with the jump, the administration appears well behind its original goal of having 800,000 people signed up through the state and federal exchanges in the first two months. Still, the figures could be a sign the rollout finally has some positive momentum after a catastrophic launch.

Bloomberg reported on Monday that the HHS will say 100,000 people selected plans through the federal exchanges in November, a nearly four-fold increase over the almost 27,000 that signed up in the first month of its operation.

The Pueblo Chieftain's Loretta Sword updated numbers for Colorado over the holiday weekend:

More than 71,000 Coloradans have created accounts on Connect for Health Colorado, the state marketplace for insurance coverage under the federal Affordable Care Act, often referred to as Obamacare.

The initial rollout of the online health insurance marketplaces, both federal and to a lesser extent in Colorado, were marred by disastrous and in most cases preventable errors. Here in Colorado, many of the functions to calculate available subsidies for health insurance buyers weren't available when the site rolled out on October 1st. A larger and more fundamental problem was discovered in the process flow for new signups to Colorado's health insurance exchange, which has seen thousands of applications stall while awaiting denial for Medicaid coverage. Slowly but surely, the weeks-long story of epic failure is being edged out by newer stories of success–halting, still far below expectations set before the beginning of October, but enough to provide hope that the situation will be brought under control in time to work.

Ever since the passage of the Affordable Care Act over three years ago, Democrats have banked on the promise that at some point, the law would begin providing tangible and undeniable benefits to the public. The answer from Democrats to the hysterical, exaggerated claims from Republicans about the effects of Obamacare was simply going to be a system that voters could see with their own eyes was working.

Needless to say, the last few weeks of highly public dysfunction, at the exact moment a functioning new system was supposed to be reassuring the public, put a giant hole in the plan. When you consider the horrible political situation Republicans were in at the end of the October government shutdown, Obamacare's website catastrophe was the best thing that could have possibly happened for the GOP. The reversal of political fortunes in such a short time was enough to induce whiplash.

But today, it's looking more like delayed political payoff for Democrats from Obamacare, not destruction. For all the self-inflicted damage caused by websites that weren't ready for prime time, if the public's confidence can be restored in the system by seeing it work, even belatedly, that's a win for Democrats. In fact, the startup problems might even work to the long term advantage of Democrats, by lowering expectations which can then be met or exceeded.

The fact is, Democrats still have the upper hand in a debate over something that most everyone agrees is necessary. Unforced errors have extended the pain, but the ultimate goal hasn't changed. Even in the ugliest recent polling on health care reform, voters don't want it repealed–they want it to work. That's an advantage no amount of disparagement can overcome.

Fox News host Bill O'Reilly dedicated Monday's "Talking Points Memo" segment to denouncing what he called a "'Happy Holidays' syndrome" propagated by "secular progressives" and "pressure groups like the ACLU."

As evidence, O'Reilly displayed a flyer for Macy's "Santa Land" that touts it will help customers with their "holiday wish list."

"So here's my question to Macy's: what holiday is Santa celebrating?" he asked. "The Winter Solstice? The birthday of a reindeer? What?"

A "War on Christmas" is perennially alleged to be underway by Christian conservatives, who blame "atheist activists" for various perceived infringements on the right to publicly observe an essentially religious holiday. In Texas this year, state legislators passed a "Merry Christmas Bill," affirming the right of public school students and teachers to "offer traditional greetings."

The truth is, of course, that Christmas has lost its sanctity to decades of commercialization far more than to any anti-religious political agenda. Aggrieved Christians also sometimes overvalue their right to free religious expression against the rights of others to not observe any religion. Businesses enforce holiday-neutral expressions for practical reasons. Public spaces and organizations have an obligation to be respectful of everyone. In the end, the "War on Christmas" seems to exist mostly in the minds of those who promote the idea that such a thing exists at all. We submit that for most Americans, it just isn't a big deal either way.

With that said, we've already been told to watch for a Colorado "Merry Christmas Bill" next session.

Gov. Hickenlooper Serves Up the Sage Grouse for Thanksgiving

It appears that Gov. John Hickenlooper will be serving-up the greater sage-grouse for Thanksgiving this year.

In comments during a visit to the Western Slope with local officials, he claimed that the science was unclear as to whether oil and gas drilling affected wildlife habitat for the bird that is in dangerous peril of being listed as an endangered species.

It’s hard to say that those activities are the cause of diminishing numbers of sage-grouse.

Apparently, Gov. Hickenlooper doesn’t listen to wildlife biologists at the U.S. Fish and Wildlife Service and his own administration at Colorado Parks and Wildlife, which found that oil and gas drilling poses the single greatest threat to greater sage-grouse populations in Colorado—a threat that is “increasing exponentially”.

“In the eastern portion of GrSG [greater sage-grouse] range (Colorado’s population), oil and gas development was seen as being the highest threat to GrSG, followed by infrastructure as associated with energy development and urbanization.” [emphasis added]

It’s unfortunate to see Gov. Hickenlooper use the bully pulpit for providing credibility to the junk science efforts of the Garfield County Commissioners, who are using thousands of taxpayer dollars to bring-in a Texas-based private consultant firm and industry-favorite wildlife biologist contrarian because they didn’t like the results of what the wildlife biologist staff at Colorado Parks and Wildlife were recommending.

The simple truth is that we need Gov. Hickenlooper’s leadership to drive a plan based on science that protects wildlife habitat and prevents an animal from becoming so rare that it is too expensive or impossible to save.

Unfortunately, Gov. Hickenlooper’s track record for conservation and protecting wildlife habitat is a little thin. This past summer, he joined four Republican governors on a letter opposing endangered species listing for another bird found in the West.

Protecting wildlife habitat for the greater sage-grouse isn’t just good for the bird, but it helps protect the greater landscape, hunting and fishing opportunities, and local economies throughout the Rockies. The animal shares the same wildlife habitat as big game such as mule deer or elk. Often times, these animals are face the same threats. In fact, mule deer populations saw huge drops due in part to oil and gas drilling.

Let’s do better by science and come up with a common sense plan that protects wildlife habitat and ensures oil and gas operators act responsibly on public lands.

So Long, Sheriffs: Gun Lobby Lawsuit Loses More Steam

An important development last Wednesday in the ongoing legal action by the gun lobby against gun safety legislation passed in Colorado this year, as reported by the Associated Press' Ivan Moreno. Don't let this slip down the Thanksgiving weekend memory hole:

Sheriffs in most of Colorado’s 64 counties filed the lawsuit in May, saying the new regulations violate the Second Amendment. The sheriffs are elected and represent rural, gun-friendly parts of the state.

In her ruling, Krieger said sheriffs still can choose to join the lawsuit in an individual capacity, and they’ll have 14 days to make that decision. But they cannot, as a group, sue the state in their official capacities.

“If individual sheriffs wish to protect individual rights or interests they may do so … however, the sheriffs have confused their individual rights and interests with those of the county sheriff’s office,” Krieger said.

We'll be the first to admit that rounding up a majority of Colorado county sheriffs–generally conservative elected officials who have been boosted for years by pro-gun groups like the Rocky Mountain Gun Owners–to publicly front the opposition to these new gun safety bills was a brilliant public relations move. In Colorado, the huge difference between elected conservative county sheriffs who opposed the new laws for political reasons and appointed police chiefs who generally supported them for practical reasons was lost on the public. Furthermore, some of these county sheriffs, like Weld County Sheriff John Cooke, are in fact distantly on the fringe of the gun safety debate, standing in opposition to all background checks for gun purchases. It's always been our opinion that if the voting public understood the positions held by many of these elected sheriffs, those badges wouldn't count for nearly as much.

And as the Denver Post's Ryan Parker reported on this same ruling, another major component of the fear-based messaging against this year's gun safety bills has been invalidated–again.

Krieger dismissed the claim that the state legal language dealing with readily converted gun magazines — those with removable base plates, allowing for additional rounds to be added via an extender — is "unconstitutionally vague."

Krieger said that Technical Guidance letters issued by the state Attorney General's Office after the magazine-limit law passed, outlining the interpretation of the "designed to be readily converted" component of the mag-ban measure, sufficiently addressed that issue.

In the finding, Krieger wrote that magazines with removable base plates — which most possess — "are not considered to be 'designed to be readily converted' into large-capacity magazines for purposes of enforcement of the statute."

The claim that the language in the magazine limit's provisions regarding the "convertibility" of magazines to higher capacities could "ban all magazines" was heavily promoted by conservatives during and after the gun safety debate this year. Lawmakers and conservative pundits like Jon Caldara warned in the most alarmist terms they could find of these "far-reaching consequences," either unintended or part of a deliberate conspiracy to "ban all guns," that would result from the passage of House Bill 1224.

It's important to understand that a very large part of the backlash from gun owners to passage of these laws is based directly on this misinformation. The media did nothing to refute these claims, even after GOP Attorney General John Suthers issued his technical guidance on the new law that entirely disproved them. Reporters like Ryan Parker of the Post and Kyle Clark of 9NEWS subsidized these unfounded rumors rather than honestly looking at them. Proponents, for their part, insist the hysteria over the magazine limit's "unintended consequences" was always hogwash, and that Colorado is hardly the first state to limit magazine capacity. The language of House Bill 1224 is consistent with that of other states, and the federal 1994 assault weapons ban that withstood a decade of court challenges.

Democrats need to realize that this misinformation, which they scoffed at among themselves but totally failed to publicly respond to this year, has done enormous political damage. During the legislative debate and especially during the recalls this summer of two Democratic Colorado senators, a strategic decision was made to avoid direct confrontation on the gun safety bills. Given the outright lies being spread about these bills, and the media's failure to accurately report on them, that decision was nothing short of catastrophic.

It isn't just a lecture in hindsight, folks. Beginning in January, Colorado Republicans intend to make Democrats talk about guns every day, and Democrats must be ready. Republicans believe they have found the Achilles' heel of adversaries who have been trouncing them at the polls for a decade in this state. As is often said in politics today, being right is not enough. Democrats will either win this message battle or die by it in 2014.

The Bitter Harvest: Scarcity and Abundance

I spent Father's Day of this year reflecting on the the challenges of Colorado's 4th Congressional District, a landscape of both abundance and scarcity.  A land where federal programs have provided an abundance for some; for others, only the prospect of increasing scarcity.  A land so rich in natural resources that it's hard to comprehend that any of its residents are challenged in the way they are today.

As we witness the growing chasm between the abundance for some and scarcity for others – it's mind-numbing for anyone paying attention.

Then in September the US House of Representatives, aided by the leadership of Cory Gardner, voted to systemically dismantle the safety nets for our country's most challenged residents; a $40 billion cut in the Supplemental Nutrition Assistance  Program that will not only further decimate existing safety nets – but eliminate 55,000 Coloradans from being eligible.  Just prior to the final House vote in September, Congressman Gardner had this to say:

“I’m anxious about it,” said Gardner, a few hours before the vote. “I’m glad we’re moving forward on a path that should complete the farm bill but the road has not been easy. I don’t want to be overconfident at any point.”

Next stop?  The 2013 Government shutdown: a brave act of leadership that cost the US economy just over half of the total amount of the House proposed cuts to the food nutrition program. 

It falls in to the category, "I wish I was making this up."

When Congress returns to finish this session on December 9, it will be the last opportunity to pass a Farm Bill, an effort almost ignored by the Press yet perhaps the most apt symbol of a dysfunctional Washington.

But I would argue the political dysfunction that holds the Farm Bill hostage is only surpassed by the pragmatic dysfunction of what the legislation will deliver to the American taxpayer: the Republican House passed farm bill ends conservation compliance as a precondition for subsidies; the Senate version requires compliance as a precondition for crop insurance. They're cutting $40 billion from vital food programs while taking away the last constraint on farmers who don't practice sound soil conservation.  Sugar will remain heavily subsidized, while fruits and vegetables have no seat at the table; the US taxpayer has shelled out almost $4 billion in payments to Brazil because our cotton subsidy program is in violation of world trade agreements.  The Senate is attempting to limit the taxpayer exposure to milk subsidies, while the House version could lead to out-of-control government subsidies.

And while the proposed cuts by my self-avowed, fiscally-conservative Congressman will further exasperate hunger, fear not fellow billionaires: your subsidies are not at risk.

Perhaps Robert Reich summed it up best:

To call the Congress that enters its final weeks of the year a "do-nothing" Congress is far too generous. Not only has it done nothing to reform the nation's obsolete immigration laws, or our absurd and unfair tax system, or the government's heinously intrusive methods of spying on its own citizens. But in failing to extend unemployment benefits to 1.3 million jobless people who are about to lose them, or enact any climate legislation, or renew the ban on plastic guns, or end the draconian budget "sequester" that willy-nilly cuts spending on defense and on the poor and needy, it has done worse than nothing. As the year reaches a close, America is worse off than it was when the 113th Congress began. I don't mean to draw a false equivalence. It is the Democrats who have accomplished nothing. Republicans, by contrast, have accomplished exactly what they intended.

So as we struggle implementing 20th century federal programs into a 21st century economy, as we continue to shower the largess of the American taxpayer on a select few agricultural producers, as we struggle to maintain rural viability because of the lack of communications and infrastructure investments – and as we watch the collapse of some regional ecosystems and their finite natural resources – it would be an appropriate time for rural America to exercise some self-reflection:  Is Rome burning? Are our rural communities benefiting from the current programs? Should we change course? Is it time to transition to new crops? Do we really "feed the world"?

Tough questions.  And most in rural America rarely enjoy such questions.  But ask them, we must.  It's time for new thinking.  It's time to begin the transition of how we adapt to changing climates, how we embrace a new energy future and how we provide basic safety nets that provide dignity and support to every one of our neighbors. 

In our state alone, the childhood poverty rate has grown faster than only one other state in the entire union.  More than Colorado 200,000 children now live in poverty – twice as many as just one decade ago.  We're better than this – and given that it is generally successful state programs that morph in to federal programs, let's bring Colorado's diverse interests together to solve this problem.  We take on big visions in the Centennial state – it's how we roll. We've lead the national narrative on clean energy, ended the prohibition on cannabis and are beginning the process of tackling air quality issues around natural gas development. 

We have an embarrassment of riches in human capital, natural resources and forward thinkers, giving us an abundance of opportunity -   limited only by a scarcity of leadership.
