Greg Brophy Nimbly Dances Around Obvious Secession Questions

[I]f some people in several of the counties in his expansive northeast Colorado Senate district have their way, the Wray Republican who’s seeking the GOP nomination to challenge Democratic Gov. John Hickenlooper soon could live in another state.

Brophy, who’s in town to attend this weekend’s Club 20 fall meeting, said that while he encouraged commissioners in numerous counties in his district to place a 51st state initiative on their November ballots, he isn’t necessarily in favor of the idea…

“I encouraged my county commissioners to move forward with this to catch the governor’s attention and the state Legislature’s attention,” Brophy said. “I think that most of the counties will vote to secede, but it won’t pass through the state Legislature.”

If such a vote passed, though, Brophy said he would be obligated to introduce a measure into the Legislature if his constituents demanded it of him, even though he’s not sure how he would vote on it.

?Sen. Greg Brophy's (albeit wholly realistic) lack of confidence in the ultimate success of the movement to split a number of rural Colorado counties, including Brophy's own Yuma County, into the separate state of North Colorado, could upset secession's proponents. If somebody "encouraged" you to do something, but then told a newspaper on the other side of the state that you're not "necessarily in favor" of it, wouldn't you find that a little two-faced?

With that said, it makes an obvious kind of sense that Brophy would keep his options open on how to vote on legislation to allow these counties to secede even if he was its sponsor–after all, he needs to preserve his status as a serious contender for governor of, you know, the rest of Colorado. We've been wondering how Brophy intended to juggle these competing interests.

Caldara Vows To “Gypsy Vote” In Recall Election

On Tuesday, we took note of a new website from the right-wing Independence Institute that appears to give instructions on how to vote in the upcoming recall special elections in Colorado Springs and Pueblo, even if you don't live there. The severely flawed premise of the site is a fictitious "unintended consequence" of this year's Colorado House Bill 1303, the Voter Access and Modernized Elections Act, which some Republicans have claimed might allow voters from outside the two senate districts in question to participate. As even Secretary of State Scott Gessler's office has confirmed, that's false: a voter must have already moved to the district to claim their "intention" to reside there, and any false statement in the process of registering to vote is a crime. To actually vote under those false pretenses is felony voter fraud.

But nonetheless, as a press release from the Independence Institute announces today:

The Independence Institute president will exercise his legal voting rights in next week's recall election, casting a ballot in a district outside his current residence.

Independence Institute president Jon Caldara's decision to vote in the Senate District 11 recall kicks off the "Bring in the Vote" educational campaign, highlighting the significant legal changes in Colorado's "Voter Access and Modernized Elections Act," signed into law by Gov. John Hickenlooper on May 10.

Calling attention to the lax new election law sponsored by Senators John Morse and Angela Giron, both facing recall elections, Caldara announced that he has the "intention" to make his permanent home in Senate District 11, currently represented by Morse.

Under HB 1303, the "intention" to establish residence along with a few minor requirements such as being 18 years of age, living in Colorado for 22 days, and having an address in the district, permits almost anyone to "Bring in the Vote" and cast a ballot in any district.

"It is my belief that this extremely sloppy new election law was designed to legally move voters into districts where their vote is most useful. I will show how this dangerous new law works by easily and legally voting in the John Morse recall election," explained Caldara.

"John Morse sponsored this law and worked its passage through the Senate. And now, sadly, under this law future Colorado elections will be decided by which candidate has the most buses." [Pols emphasis]

Now folks, we don't know where Caldara is getting his legal advice, but we surer than hell wouldn't try this based on every sane interpretation of House Bill 1303 we've heard. Certainly if the legal question hinges on "intent," Caldara's "intent" is to mess with the system–and quite possibly to encourage fellow Republicans to do the same. That and to draw attention to himself, naturally. Either way, we are very confident that no one on the Democratic side of these recalls has any plans to bus people in to so-called "gypsy vote," because they all think this half-baked theory is completely wrong.

But apparently Jon Caldara isn't convinced. Maybe he's right–or maybe he's setting fellow conservatives up for disaster.

What these numbers mean is that 561 guns were confirmed to be sold to legal buyers, not to criminals. That's 561 guns that might otherwise have been sold, if not knowingly to criminals, then at least without the buyer's peace of mind knowing they didn't sell a gun to someone who shouldn't have one.

As for the ten attempted gun purchases that were denied? Arguing against that reminds us of Rep. Mark Waller's defense of House Bill 12-1048, which would have eliminated "redundant" state background checks. Colorado passed the CBI background check law after a man named Simon Gonzales bought a gun after a federal check missed the local restraining order. Gonzales proceeded to kill his entire Castle Rock family. Waller argued dismissively for HB12-1048, saying "that one act is the reason that we have this statute on the books."

It just seems wrong to tell a victim of even one shooting a law that might have stopped it is "not persuasive."

In Denver Post interview, Coffman affirms opposition to birthright citizenship

How fun it would be to sit on a newspaper's editorial board and interview all the candidates who traipse by the office begging for an endorsement.

Over the years, The Denver Post has dabbled with putting those interviews online, where they'd be a valuable public resource, but this isn't done in any systematic fashion, unfortunately.

But, moving its nose slowly in the right direction, The Post's editorial-page staff produces an online video-interview, called the Roundup, which proved its worth this week with an illuminating interview with Rep. Mike Coffman.

Yesterday's program broke news when Coffman affirmed his opposition to the longstanding U.S. law granting citizenship to people born on American soil, even if their parents are not citizens. This is commonly referred to the policy of birthright citizenship. 

Coffman: I mean, the current law is, and the United States is separate from other countries, is that if you are born in the United States, you are, in fact, a citizen of the United States. You know, I think we should probably be, adopt the policies of other countries, that you are a citizen of your parents. But the fact is, that we have children who were born under current U.S. law. And therein lies the challenge that I have, particularly in meeting families up in what is a very new district. And that –

Denver Post Editorial Writer Tim Hoover: You’d see that changed, right? Is that what you’re saying?

Coffman: Sure. I mean, I think we ought to look at that. But , the fact is, what we have to understand, the fact is, we don’t revoke citizenship once it’s given. [BigMedia emphasis]

During his interview with Hoover, Coffman, who's considered one of the most endangered Congressman in the country, also for the first time offered a vague explanation of how his immigration position is different from the bipartisan bill passed by the Senate. Coffman said:

Coffman @7:30: Where I differ from what the Senate did is, to go beyond that [temporary] legal status, you really do have a trigger. And you really do have to demonstrate that we’ve secured our border. And you really do have to demonstrate that we have mechanisms in place and the will to enforce all of our laws. And that’s a real concern of mine…”

Coffman also said he wants tougher English-language standards and other qualifications for citizenship:

Coffman @10:05: I think we really ought to raise the standards for citizenship across the board. I think citizenship really is sacred. I think between myself and my late father, we have 42 years of military experience and four wars. And I think we understand the value of American citizenship. And so, I think that when we say that somebody ought to know English to become a United States citizen, I think we really ought to mean that they ought to know English and we should raise bar on that. When we say that somebody ought to understand the civic culture of our country, we really mean they ought to understand that to include a firm knowledge of the Constitution of the United States. I think we need to raise the bar on citizenship , period.

And Coffman also offered a new option for Dreamers to attain citizenship, saying he's drafting a bill to allow young people, who entered the U.S. illegally, @8:40, "to achieve citizenship through military service and through higher education." Previously, Coffman only supported allowing so-called Dreamers to achieve citizenship through military service.

Obviously, many questions flow from The Post's interview with Coffman:

Will he be introducing a bill to stop birthright citizenship? What specifically are his proposed triggers for citizenship? What does sufficient immigration enforcement look like? How else does his immigration position differ from what's in the Senate bill? Does Coffman support a path to citizenship for adults? (After speaking with Coffman, The Post's Hoover doesn't think so, because he wrote that Coffman "favors legal residency, but not citizenship, for adult illegal immigrants.") What does Coffman think of the accusation that he's changing his positions on immigration and other issues simply to get re-elected in a more moderate new district?

That's the point of the editorial page, partially, to raise questions. The Roundup did so this week, by putting good questions to Coffman. The Post should offer more long-form interviews on its editorial-page website. In addition to the weekly Roundup show, why not post all issue and endorsement interviews?
